Zhang Shaohan's brokerage dispute was changed to compensate for the loss of unreleased album
according to Taiwan media reports, Zhang Shaohan was sued by his former employer Qingtian brokerage company and Fumao record company for more than 34.65 million yuan (about 8.31 million yuan) due to a contract dispute. After the case was abandoned and sent back, the high court made a change of judgment on the 30th of the first instance, believing that the album that had been produced could not be released after Zhang Shaohan's termination of the contract, so the change of judgment required Zhang Shaohan to compensate more than 4.09 million yuan (about 980000 yuan), which can be appealed.
in this case, Qingtian and Fumao company sued and pointed out that Zhang Shaohan did not release 10 records according to the contract signed at the beginning, which means that he recorded and released 6 records; in addition, he did not cooperate with the performance arranged by the company, so they claimed compensation respectively.
as for Zhang Shaohan, it was originally agreed with Qingtian company to release 10 records within five years, but Qingtian company only released one record for more than seven months a year, which was Qingtian company's first violation of the contract; in addition, she also believed that Qingtian company entrusted part of the performance work to Fu Mao company without her consent, which made the accounts confusing and unclear, and the two sides could not cooperate. Therefore, she sent a deposit letter on July 4, 2011 to terminate the contract
The case was heard by the court. In the first instance, the Taipei District Court only ruled that the quasi Qingtian company could request an advance payment of 40000 yuan (about 9600 yuan). After the appeal in the second instance, the high court increased the size and changed the judgment that Zhang Shaohan must compensate the clothing modeling fees paid by Fu Mao records by 630000 yuan (about 150000 yuan). After the case was heard by the Supreme Court, after these two compensations were determined, the remaining requests of Qingtian and Fumao were sent back for a further trial by the high court
The first instance judgment was changed on the 30th, and the high court held that before the termination of the contract, Fu Mao records had begun to produce Zhang Shaohan's seventh album, of which seven songs had already paid the production costs of composition, lyrics and so on. In addition, the high court also estimated that Zhang Shaohan's failure to release his seventh album would cause a loss of more than 3.6 million yuan (860000 yuan per month) to Fu Mao company according to the email of Lin Longxuan, the producer of the first six albums. In the final retrial, Zhang Shaohan had to pay an additional 4.09 million yuan (about 980000 yuan) in compensation
