original title: "fraudulent box office" means the draft law on promoting the film industry attracts attention

according to the Voice of China News vertical and horizontal report, the 22nd session of the standing Committee of the 12th National people's Congress will hold its first plenary session at 9: 00 today. According to the agenda of the meeting proposed by the chairmanship meeting, a number of draft laws, such as the draft National Defense Traffic Law, the draft Law on the Promotion of the Film Industry, the draft Law on traditional Chinese Medicine, and the draft amendment to the Marine Environmental Protection Law, will be submitted for deliberation.

in recent years, more and more audiences have entered the cinema, more and more investment has also entered the film industry, the film industry has once again entered a period of vigorous development, giving birth to a large number of hundreds of millions of works at the box office. In 2015, China's film box office exceeded 44 billion yuan, making it the second largest film market in the world after North America. What is more gratifying is that the contribution rate of domestic films is more than half. Under such circumstances, the draft law on the promotion of the film industry has attracted special attention.

it is reported that with the rapid growth of China's film box office, problems such as concealment and false reports have always existed, but now they have developed into more serious production of false box office. "box office fraud" can be simply summarized as two routines: "stealing the box office" and "buying the box office". "stealing the box office" takes the cinema as the main body, and there are many means, such as "handwritten ticket", "dual system" and so on. This kind of behavior has been explicitly prohibited by the Film Bureau.

"buying the Box Office" is dominated by producers and distributors, initially to increase exposure, increase production, or to hit box office records, but has recently begun to be closely related to finance, capital and even stock prices. Behind "Buy the Box Office", the film is often laying out a big game of chess, which will do more far-reaching harm to the film industry. All these have exposed the institutional risks of Chinese films, so we all hope to regulate and restrict them effectively through legislation.

the first draft of the Law on the Promotion of the Film Industry submitted to the standing Committee of the National people's Congress last October stipulates that cinemas should install computerized ticketing systems in line with national standards, carry out accounting according to law, and truthfully count the sales income; if the sales income is not truthfully counted, a fine of not less than 50, 000 yuan and not more than 500000 yuan shall be imposed by the film department of the people's government at the county level. If the circumstances are serious, it shall be ordered to suspend business for rectification; if the circumstances are especially serious, the license shall be revoked by the original license issuing organ.

many people in the industry believe that the maximum fine of 500000 yuan is too low to deter market violations such as omitting and concealing the box office and buying the box office. According to media reports, the box office of some cinemas can reach tens of millions of yuan a year. We will continue to pay attention to whether the second draft submitted for consideration today will have further provisions in this regard.

in addition, there is another point that everyone is particularly concerned about, that is, it has been said that domestic films should be encouraged and supported, and it is worth looking forward to whether and how the law can help.
